Kiddo AI — Terms of Service

Welcome to Kiddo AI. These Terms of Service ("Terms") govern your use of the Kiddo AI mobile application ("the App," "we," "us," or "our"). By creating an account or using Kiddo AI, you agree to be bound by these Terms. If you do not agree, please do not use the App.

Kiddo AI is an AI-powered personalized storybook platform for children ages 2–12. Parents and guardians create child profiles, and our AI generates unique stories where the child is the main character — complete with illustrations, audio narration, and more.

Please read these Terms carefully. They contain important information about your rights, obligations, and our limitations of liability.

1. Eligibility and Account Registration

1.1 Age Requirement

You must be 18 years of age or older (or the age of majority in your jurisdiction, whichever is greater) to create a Kiddo AI account. By creating an account, you confirm that you meet this requirement.

1.2 Account Creation

• Accounts are created exclusively through Google Sign-In or Apple Sign-In. We do not offer username/password registration.
• By creating an account, you confirm that you are a parent, legal guardian, or authorized caregiver of the children whose profiles you create.
• Each account belongs to a single family unit.
• You are responsible for maintaining the security of your account and for all activity that occurs under it.

1.3 Children Cannot Create Accounts

Children ages 2–12 do not create accounts. Parents and guardians create and manage child profiles on their behalf. All child data is entered and controlled by adults. See Section 9 for details on children's privacy.

2. Family Accounts and Member Roles

2.1 Roles

Kiddo AI supports family sharing with two roles:

• Admin — The account creator. Admins can invite and remove family members, manage all family settings, manage children's profiles, and manage the subscription.
• Member — Invited caregivers. Members can access all children's profiles, create and read stories, and use all content features. Members cannot manage other family members, change account-level settings, or manage the subscription.

2.2 Invitations

• Admins invite members by email address.
• Invitations expire after 7 days and can be resent.
• All family members share access to children's profiles, stories, collections, subscription benefits, and usage limits.

2.3 Admin Responsibility

The Admin is responsible for all activity on the family account, including the actions of invited Members. The Admin controls who has access to the account and its associated children's profiles.

3. Subscriptions and Billing

3.1 Subscription Tiers

Kiddo AI offers two tiers:

• Free — Limited story creation per month, standard audio narration (Google TTS), 1 supporting character per story, and basic features.
• Plus (paid) — Expanded story creation limits, premium audio narration (ElevenLabs), up to 3 supporting characters per story, story collections, story sharing, cover and illustration set generation, and priority access to new features.

3.2 Billing and Payment

• Billing periods: Monthly, Quarterly, or Yearly.
• Payment processing: Payments are processed through the Apple App Store (iOS), Google Play Store (Android), or Stripe.
• Subscription management: Handled by RevenueCat.
• Auto-renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• Charges: Payment is charged to your Apple ID account, Google Play account, or Stripe payment method at confirmation of purchase.
• Price changes: Subscription prices may change. We will notify you in advance of any price increase, and your continued subscription after the change constitutes acceptance of the new price.

3.3 Cancellation

You can cancel your subscription at any time through:

• In-App: Menu → Billing & Payment
• iOS: Apple App Store subscription settings
• Android: Google Play Store subscription settings

After cancellation, Plus features remain accessible until the end of your current billing period. Once the period ends, your account reverts to the Free tier. All existing stories, reading history, and data remain accessible on the Free plan.

3.4 Refunds

Refunds are handled by Apple or Google according to their respective refund policies. Kiddo AI does not process refunds directly. For payments made through Stripe, please contact us at hello@kiddoai.net.

3.5 Usage Limits

Each subscription tier includes per-period limits for story generation, story reading, image set generation, cover image generation, and audio generation. Usage counts reset at the start of each billing period. Bonus credits may be earned through in-app achievements and are added on top of your tier limits.

4. AI-Generated Content

4.1 How Stories Are Created

Kiddo AI uses artificial intelligence to generate personalized stories based on parameters you provide, including your child's profile data (name, age, interests, fears), story settings, themes, and any custom instructions. Stories include AI-generated text, illustrations, and audio narration.

4.2 Content License

You receive a personal, non-exclusive, non-transferable license to use, read, share, and display your generated stories within the App and through the App's sharing features. This license is for personal, non-commercial use.

You do not own the underlying AI models, algorithms, or content generation technology. Kiddo AI retains all rights to its technology and the right to use anonymized, aggregated content data to improve AI models and app quality.

4.3 Content Accuracy and Disclaimer

AI-generated stories are created for entertainment and educational purposes only. While we employ comprehensive safety reviews (see Section 5), please be aware that:

• AI content may occasionally contain errors, inconsistencies, or unexpected output.
• We do not guarantee that all AI-generated content will be perfectly appropriate for every child in every situation.
• Parents and guardians are encouraged to review stories, especially for younger children (ages 2–5).
• Kiddo AI is not a substitute for professional educational, therapeutic, or medical advice.

4.4 Custom Instructions

You may provide custom text instructions to guide story generation. These instructions are screened for child safety. Kiddo AI reserves the right to reject or modify instructions that could result in inappropriate content. You must not attempt to use custom instructions to generate harmful, violent, sexual, discriminatory, or otherwise inappropriate content.

5. Content Safety

We take the safety of AI-generated content seriously. All stories undergo a multi-provider AI pedagogical safety review, which evaluates content across the following categories:

• Age appropriateness
• Emotional safety
• Psychological accuracy
• Moral value clarity
• Violence and conflict level
• False promise detection
• Diversity and inclusion
• Readability and clarity
• Educational value
• Cultural sensitivity

User-provided text (custom instructions, story ideas) is also screened for child safety before processing. Despite these safeguards, no content filtering system is perfect. We strongly recommend parental oversight, particularly for younger children.

Kiddo AI reserves the right to review, moderate, or remove any content — including public stories, reviews, and collections — that we determine violates these Terms or poses a risk to child safety.

6. User-Generated Content and Public Features

6.1 Public Stories

You may choose to make your stories visible to other Kiddo AI users through the Explore section. Making a story public is optional and off by default. Public stories may appear in trending, recommended, new release, and search listings. Kiddo AI reserves the right to remove any public story that violates these Terms or our content guidelines.

6.2 Ratings and Reviews

Users can rate stories (0–5 stars) and leave comments. You control whether your name is displayed on reviews through the showAuthorName toggle in settings. All reviews must be respectful and appropriate. We reserve the right to remove offensive, misleading, or abusive reviews.

6.3 Collections

Plus subscribers can create story collections and choose to make them public. Other users can follow public collections. Public collections must comply with our content guidelines.

6.4 Responsibility for Public Content

By making content public, you represent that it complies with these Terms. You understand that public content is visible to all Kiddo AI users, including other families.

7. Acceptable Use

By using Kiddo AI, you agree not to:

• Use the App for any illegal purpose.
• Attempt to generate content that is harmful, violent, sexual, discriminatory, or inappropriate for children.
• Circumvent, bypass, or interfere with content safety filters or moderation systems.
• Share account credentials with unauthorized individuals.
• Use the App on behalf of a child without being their parent, legal guardian, or authorized caregiver.
• Scrape, reverse engineer, decompile, or attempt to extract AI models, training data, or proprietary technology.
• Upload content that infringes on the intellectual property rights of others.
• Use the App to harass, bully, or harm other users.
• Create false, misleading, or fraudulent reviews.
• Exploit bugs, vulnerabilities, or API endpoints for unauthorized purposes.
• Use automated tools, bots, or scripts to interact with the App without our written permission.
• Interfere with or disrupt the App's infrastructure or other users' experience.

Violation of these rules may result in immediate suspension or termination of your account at our sole discretion.

8. Parental Responsibilities

As a parent, legal guardian, or authorized caregiver using Kiddo AI, you are responsible for:

• Supervising your child's use of the App, including their interaction with stories and content.
• Providing accurate child profile information so the AI can generate age-appropriate and relevant content.
• Reviewing AI-generated stories, especially for younger children (ages 2–5), to ensure suitability.
• Managing Child Mode settings and reading controls within the App.
• Controlling family access — deciding which family members can access children's profiles and stories.
• Ensuring legal authority — confirming that you have the legal right to create profiles for the children you add to your account.

9. Children's Privacy and COPPA Compliance

Kiddo AI complies with the Children's Online Privacy Protection Act (COPPA) and GDPR Article 8 regarding children's personal data.

Key points:

• Children do not interact with the App independently in any way that involves data collection. All child data is entered and managed by parents or guardians.
• Before creating a child profile, parents must provide active consent acknowledging they have read and agree to our Children's Privacy Policy.
• Parents have the right to review, modify, or delete their child's data at any time through the App.
• We do not share children's data with advertisers or data brokers.
• We do not use children's data for advertising, profiling, or marketing.
• We do not condition access to the App on the collection of more personal information than is reasonably necessary.

10. Intellectual Property

10.1 Kiddo AI Property

The following are owned by or licensed to Kiddo AI and are protected by applicable intellectual property laws:

• The Kiddo AI app, brand, logo, and mascot (Koda the Koala)
• All UI/UX design, visual assets, and app architecture
• AI models, algorithms, and content generation systems
• Voice characters, background music tracks, and preset story characters
• The "Kiddo AI" name and all associated trademarks

10.2 Restrictions

You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit the App, its technology, or its content, except as expressly authorized by these Terms (such as sharing stories through the App's built-in sharing features).

11. Third-Party Services

Kiddo AI integrates with third-party services for core functionality:

These services have their own terms of service and privacy policies. Kiddo AI is not responsible for the practices, availability, or content of third-party providers. Your use of these services is subject to their respective terms.

12. Push Notifications

• We request notification permission explicitly. If you decline, no push notifications are sent.
• Notification types include: story completion alerts, milestone unlocks, shared story updates, reading streak milestones, illustration-ready alerts, reading reminders, new feature announcements, subscription alerts, and family invitations.
• You can enable or disable notifications and reading reminders at any time in the App's settings.

13. Disclaimer of Warranties

Kiddo AI is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Without limiting the above, we do not warrant that:

• The App will be uninterrupted, timely, secure, or error-free.
• AI-generated content will be accurate, complete, or appropriate in all circumstances.
• Defects will be corrected or that the App is free of viruses or other harmful components.
• The results obtained from the App will meet your expectations.

Some jurisdictions do not allow the exclusion of certain warranties. In such jurisdictions, the above exclusions apply to the fullest extent permitted by applicable law.

14. Limitation of Liability

To the fullest extent permitted by applicable law:

• Kiddo AI, its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App.
• This includes, without limitation, damages arising from: AI-generated content, service interruptions, data loss, third-party service failures, unauthorized account access, or reliance on information provided through the App.
• Our total aggregate liability for any claim arising out of or related to these Terms or the App shall not exceed the total amount you paid to Kiddo AI in the 12 months preceding the event giving rise to the claim, or $100 USD, whichever is greater.

Some jurisdictions do not allow limitations on incidental or consequential damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

Nothing in these Terms excludes or limits our liability for matters that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

15. Indemnification

You agree to indemnify, defend, and hold harmless Kiddo AI and its officers, directors, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the App in violation of these Terms.
• Content you make public through the App.
• Your violation of any applicable law or third-party rights.
• Any misrepresentation regarding your authority to create child profiles.

16. Account Suspension and Termination

16.1 Termination by You

You may delete your account at any time through the App (Menu → Account Settings) or by contacting us at hello@kiddoai.net.

16.2 Termination by Us

Kiddo AI may suspend or terminate your account at any time, with or without notice, for violations of these Terms, including but not limited to misuse of AI content generation, circumventing safety filters, or abusive behavior.

16.3 Effect of Termination

Upon termination:

• Your access to the App is revoked.
• Active subscriptions are canceled. Any remaining subscription period is not refunded unless required by applicable law.
• User data is handled in accordance with our Privacy Policy.
• AI-generated stories and associated content may be deleted.
• Family members lose access when the Admin's account is terminated.

17. Changes to These Terms

We may update these Terms of Service from time to time. When we make material changes:

• We will notify you through the App.
• The "Last Updated" date at the top of this document will be revised.
• Your continued use of the App after the changes take effect constitutes your acceptance of the updated Terms.

If you do not agree with the updated Terms, you must stop using the App and delete your account.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy and Children's Privacy Policy, constitute the entire agreement between you and Kiddo AI regarding your use of the App. They supersede all prior agreements, communications, and understandings, whether written or oral, relating to the subject matter herein.
